A federal judge who was appointed by Trump as president and ruled in favor of Trump in previous cases is now assigned to hear Trump's latest case.
District Judge Aileen Cannon of the U.S. District Court for South Florida has just accepted a new appointment, according to court filings. According to court regulations, the presiding officer of the new case is randomly selected from among the 26 judges in the district.
Cannon previously served as a prosecutor and was appointed a federal judge in 2020. After the FBI seized a trove of documents from Trump's Mar-a-Lago estate in Palm Beach, Florida last August, Cannon granted Trump's request in September to appoint a "Special Master" to classify the documents and suspend the Department of Justice's use of them for investigative purposes.
On 15 September 2022, Cannon appointed U.S. District Judge Raymond Dearie as "special master" but her rulings were eventually overturned by the 11th Circuit Court of Appeals on 1 December 2022.
New prosecution
The FBI took away thousands of documents from Sea Lake Manor, including a large number of Trump's private tax documents. On 8 June 2023, a federal grand jury in Florida filed a lawsuit against Trump, accusing him of improperly handling classified documents and obstructing justice.
After the FBI seized the documents, Trump clarified that all the documents marked with confidentiality in these documents canceled the restriction level of these documents before he left the White House, that is, these documents are no longer classified documents.
The judiciary took no action against former U.S. Secretary of State Hillary Clinton after Trump raised the issue in public speeches that former U.S. Secretary of State Hillary Clinton was found to have mishandled classified documents.
Challenge
This time Cannon is once again an ad litem judge and may be asked to recuse Trump from the case. Under federal law, prosecutors can file an application to recuse Cannon from the case if they believe she will not be able to fairly decide the case.
Cannon has a good reputation in the industry. Prominent defense attorney in Miami, Richard Klugh (Richard Klugh) confronted Cannon, who was the prosecutor at the time, in court several times. He evaluated Cannon as "very smart and talented" and a fair and impartial judge.
"I don't see anything (in Cannon) other than an excellent defense. She has no political bias," Kruger said. "She is known for providing a fair process and hearing."
Cannon was born in Colombia in 1981, immigrated to the United States as a child, and graduated from Duke University in 2003.
