Trump has long denied Democratic accusations that he staged a riot or insurrection at the Capitol. He often refers to a January 6 speech in which he called on rally attendees to be "peaceful and patriotic."

Not only did Professor Turley question this view, but another constitutional scholar and political science professor expressed similar views.

Florida Atlantic University professor Kevin Wagner told ABC News that the Fourteenth Amendment theory faces an uphill battle.

"The challenge here is that the Fourteenth Amendment doesn't have to be self-enforcing. In other words, it doesn't happen automatically, and what it means to be involved in an insurrection or insurrection and how to define it, the challenge we have is, historically, It’s not clearly defined.”
