Du Wen pointed out that as the leader of the Ministry of Civil Affairs, his department has the legal right to register and manage national social organizations.

According to public information, the Social Organization Administration Bureau (Social Organization Law Enforcement Supervision Bureau) is an internal agency of the Ministry of Civil Affairs.

The agency's responsibilities include formulating registration and supervision and management methods for social organizations such as social groups, foundations, and social service agencies, registering and managing social organizations and supervising law enforcement in accordance with management licensing rights, and guiding local registration management and law enforcement supervision of social organizations.

Du Wen pointed out that in the legal framework, the political organization of the Communist Party of China is also regarded as a social group and should fulfill the registration obligation.

But in reality, the Communist Party of China has never registered with the Ministry of Civil Affairs, and the eight democratic parties, the so-called participating parties, have never registered with the Ministry of Civil Affairs.

According to the regulations issued by the management authority of the Ministry of Civil Affairs, organizations that carry out activities in the name of social organizations without registration with the civil affairs department are illegal organizations.

In 2016, Wang Xiuying, an old lady in her 80s, wrote an open letter to Xi Jinping about the legitimacy of the Communist Party of China.

In her open letter, she mentioned that the Communist Party of China was officially established on 1 July 1921 under the rule of the Kuomintang.

Under the circumstances at the time, it was impossible for the Communist Party of China to become an open and legally established political party organization.

However, after 1949, the Communist Party of China gained the red revolutionary regime. Until today, the successive chairmen and general secretaries of the CPC Central Committee have never really solved the problem of their own legitimacy. Wang Xiuying said that she reflected this social situation and public opinion through the channel of "government information disclosure", and finally received a reply from the Beijing Municipal Committee of the Communist Party of China and the Beijing Municipal People's Government, saying that the Communist Party of China has neither registered with the Social Group Management Department of the Ministry of Civil Affairs of the People's Republic of China nor has the "Organization Code Certificate of the People's Republic of China".

Wang Xiuying directly pointed out to Xi Jinping that the Communist Party of China is both a current ruling party and a social organization. However, these exempted groups do not include the Communist Party of China and the democratic parties under the leadership of the Communist Party.

Du Wen pointed out that "the Communist Party and the democratic parties are neither on the list of exempted groups nor have they actually registered. According to the literal provisions of the system charter, the legal status of these organizations is a void and suspended state."

" As the vice minister of the Ministry of Civil Affairs, if Hu Haifeng is confirmed to be in charge of the Social Organization Management Bureau, does he have the legal possibility to revoke the registration of the Communist Party or even ban the organization? Du Wen pointed out that Hu Haifeng does have this power.

He explained that the Ministry of Civil Affairs itself is the administrative authority for the registration of social groups nationwide.

"If the Chinese Communist Party, as a social organization, does not register and carry out activities according to the law, it is not qualified to carry out activities.

Then from the logic clearly stipulated by the law, the Ministry of Civil Affairs can completely identify it as an illegal organization, ban it according to the law, arrest their party leaders, and sentence them to life imprisonment or suspended death penalty on various charges such as illegal business operations and fraud, which is completely in line with the law.

"According to the provisions of the Measures for Banning Illegal Social Organizations, the Ministry of Civil Affairs has the right to warn, order to stop activities, or even ban organizations that have not been registered and carry out activities without authorization.

Hu Haifeng is a member of the Communist Party of China. His career and even the safety of his existence are all tied to the Communist Party of China.

It is impossible to expect him to challenge the legitimacy of the Communist Party of China.

The greater irony is that Qin Yongmin and others publicly initiated the establishment of the "China Democratic Party Hubei Provincial Preparatory Committee" in 1998, and applied for registration at the Hubei Provincial Civil Affairs Department, and then established the China Democratic Party Hubei Provincial Party Committee. He was subsequently arrested by the police and sentenced to 12 years in prison for "subversion of state power" in the same year. In 2018, Qin Yongmin was sentenced to 13 years in prison and deprived of political rights for three years by the Chinese Communist Party authorities for the crime of subverting state power.
