Constitutional expert: Trump’s lawsuit in Pennsylvania is expected to win under the current situation

Alan Dershowitz, an expert on constitutional politics and an honorary professor of Harvard Law School, said this week that according to the current legal war situation, he believes that the Trump camp will be able to win the overall lawsuit in Pennsylvania.

In an interview with the "Breitbart" website on November 12, Dershowitz said that under the current circumstances, he believes that the Trump camp made a request in Pennsylvania to request that overdue votes received after November 3 be invalidated. The case is expected to win.

Dershowitz believes that the current Pennsylvania election case ultimately needs to be decided by the U.S. Supreme Court, and the current key is that the Republican plaintiff needs to verify that the number of controversial overdue ballots that have been handled separately according to the Supreme Court’s requirements is sufficient. Large enough to change the outcome of the presidential election, so that the U.S. Supreme Court will be able to intervene in the case, which will help the Trump team win the state.

He believes that if the U.S. Supreme Court intervenes in this case, it will no longer be the 4:4 ruling on the Pennsylvania absentee ballot-related bill on October 9, but it will be the Trump team's victory in Pennsylvania because of the conservative Judge Barret who has joined the Supreme Court, filling the vacant seat of the late liberal Judge Ginsburg. The current ratio of conservatives to liberals in the High Court is 6:3, and in the High Court’s ruling on October 9, four conservative judges objected to Pennsylvania’s requirement to count overdue votes.

Soon after the ballot fraud controversy broke out, U.S. Supreme Court Justice Samuel Alito ruled that Pennsylvania must separate ballots overdue after November 3 from ballots submitted on time.

Pennsylvania stated between November 3 and 6 that it had received more than 10,000 overdue mailed ballots, but in accordance with the epidemic guidelines announced by its Secretary of State Boockvar on November 1 (this practice was later ruled by a district judge to violate state law) , Allowing the time limit for absentee ballots and mailed ballots to be extended from the original November 9 to November 12.

A local Penn judge ruled on November 12 that Secretary of State Boockvar's guidelines for postponed voting deadlines issued three days before the election violated the federal law "Assisted American Voting Act" (HAVA). She does not have the right to extend the deadline for mailing votes, because only the state legislature has this right, and Boockvar's instructions are outside its authority.

The District Court of the state ruled on November 5 that counting stations across Pennsylvania will separate ballots received between November 10 and 12 that require a change of voter’s identity certificate from votes received before November 9.

Representative Fred Keller of Pennsylvania Republican said on Friday (November 13) that the Trump camp is expected to win the Pennsylvania lawsuit. He said that in the United States, “no matter what the case is, the court should rule on the basis of law.” The governor of Pennsylvania, the secretary of state, and the Democratic Supreme Court are all trying to unilaterally before the election change the election rules but these in violation of the rules will not work.
