Since being dubbed the "President-elect" by the media, Biden has set out to form a cabinet. On Thursday (December 10), Texas Republican Senator Ted Cruz warned that the Senate would not initiate the confirmation process for Biden’s cabinet nominees until all election litigation has been resolved.

In an interview with the US news website "Axios" on Thursday, Cruz said, "As long as the lawsuit is still going on and the election results are disputed, I don't think you will see the Senate take action to confirm any nominees."

Ron Johnson, chairman of the Senate's Homeland Security and Government Affairs Committee, also made similar comments on Wednesday. He said he will hold a hearing next week on the "violations" of the 2020 election.

When asked if he plans to challenge the election results, Johnson told reporters: "I want to say that it depends on our findings. I need more information, and the American people need more information. I will not accept just stopping this. Then say 'OK, let's forget about it'."

Before Johnson made his statement, Representative Mo Brooks, Republican of Alabama, said that he would raise an objection when Congress convenes a certified electoral vote next month.

According to data from the Congressional Research Service, Congress has debated and voted on opposition twice since 1887.

Many members of the Republican Senate and House of Representatives have yet to recognize Biden's "victory." More than 100 members of the House of Representatives supported the Texas lawsuit aimed at overturning the election results of the four swing states, although the Supreme Court finally rejected the lawsuit.

Trump's lawyer Rudy Giuliani said in an interview with Newsmax TV on Friday that the case was not dismissed because of the merits, but the litigation status. Therefore, the solution is for the president and some voters to transfer the case to the district court. He said that the president's legal team will continue to file lawsuits to overturn the election results.

State electors will vote next Monday, and the Trump team vowed that the legal battle will continue.
