Mainland Chinese lawyers have recently set up a "COVID-19 Claims Attorney Advisory Group" to provide legal advice to family members of patients who died of COVID-19 in Wuhan and to comfort the families of the deceased. Lawyers said they are willing to take the risk of being persecuted and to voice their voices.
On 6 March 2020, 18 Chinese lawyers initiated the establishment of a “COVID-19 Claims Attorney Advisory Group” to assist patients and family members of medical staff who died of the disease to claim compensation from the mainland China government.
In a statement, the advisory board pointed out that due to the delay in the early release of information on the "human-to-human infection" epidemic information held by government departments, the public did not take preventive measures in a timely manner, resulting in large-scale transmission and insufficient hospital beds, medical and epidemic prevention. Chain reactions such as insufficient supplies and inadequate isolation places have increased the chance of infection, infected more healthy people and medical staff. Tens of thousands of people were infected and died. Thousands of families have died in the "destruction" "massacre. The heavy losses of these victims and families should be supported and repaid, and the main body of compensation should be government departments.
Attorney Chen Jiangang, a visiting scholar in the United States and a member of the advisory board, said that the cause of the spread of COVID-19 and the seriousness of the disaster is that "human disasters are definitely greater than natural disasters."
Chen Jiangang, member of the lawyers' advisory board, said, "What we are seeing is that the mainland China government is suppressing human rights, undermining human rights, and deliberately covering up the truth of the epidemic, which has caused the epidemic to expand. In the so-called prevention of the epidemic by the mainland China government, there are a large number of human rights violations in the control measures. Such dazzling and direct killings are extremely unimaginable. "
Chen Jiangang believes that these people's losses and suffering are more a result of the government's arbitrary abuse of power and contempt for human rights. They should be compensated under the existing law. After all, the CCP government promotes itself as a country ruled by law, has its own legal system, and has lawyers.
Yang Zhanqing, the co-founder of Changsha Funeng, a non-governmental public welfare organization in mainland China, who is currently a visiting scholar overseas, also issued the "Notice on Public Welfare Institutions' Assistance to Assist New Families of Victims of Lung Infected Victims" on 27 February. He pointed out that the failure of the Chinese government to publicize the epidemic in a timely manner is the main reason why many infected people pay their lives. He is willing to provide consultation on legal claims for the family members of the infected persons and medical staff who died according to the National Compensation Law.
Former Chinese philanthropy Yang Zhanqing said, "It is possible to provide some comfort to the families of the deceased through the claim. More importantly, through this claim, the government can be urged to recognize its responsibility and bear such responsibility. Avoiding such tragedies again occur."
In fact, lawyers are very risky doing this. Since 709, a large number of human rights lawyers have been persecuted by the authorities. Since the outbreak of pneumonia in Wuhan, the Chinese authorities have launched a new wave of suppression of human rights lawyers, and many have been arrested and forced to flee.
Chen Jiangang said that although mainland lawyers may be revoked of their licenses, arrested and tortured on charges of provocation, incitement to subvert state power, etc., they cannot give up their social responsibilities as lawyers.
Chen Jiangang added, "Before China ’s persecution and terror, lawyers are willing to stand up and speak. Some lawyers are willing to stand up and voice different opinions to the mainland China government. Some lawyers are urging the Chinese government to protect human rights and stop human rights violations. Adhere to the principles of the rule of law, and do not wantonly, maliciously undermine the law, or even kill people directly. We are now conveying this voice. "
Chen Jiangang pointed out that the Chinese face a barbaric, do-it-yourself government that controls all violence and all power, and the so-called law is deceiving. Under these circumstances, even if the words "protecting human rights" written in the Constitution are just a phantom, they are willing to work hard, bear the risks, and make a sound at the time when all horses are in full swing.
He said that as Chinese, we must also wake up, know what power we have lost, and we must strive to recapture what we have lost. Only when all Chinese have this consciousness can China have hope.
The advisory board plans to formulate a preliminary claim plan based on some of the publicly reported death cases. The claim plan may be promoted through litigation. It also hopes that the government can actively communicate and reach a settlement agreement but the Chinese government has not responded to this.
